Verdicts & Settlements Condemnation

San Diego Gas & Electric v. Sycamore Estates II, LLC
San Diego Superior Court, Case No. GIC838966-1

San Diego Gas & Electric condemned a permanent power line easement over the Stonebridge community in Scripps Ranch which was to replace a temporary easement set to expire. SDG&E initially offered the Stonebridge developers $759,000 for the easement. We were then retained and demonstrated the substantial value of the property interests being condemned and the damages that resulted to the remaining property. We obtained a $10,650,000 in settlement before trial on behalf of the property owner developers.


San Diego Unified School District v. William Best, et al.
San Diego Superior Court, Case No. GIC815736-1

We represented the owner of an 18-unit apartment complex which was condemned by the San Diego Unified School District for a school expansion. The school district initially offered $1.95 million. We argued the complex had a higher value due to its ability to convert to condominiums and obtained a settlement for the property owner of $2,870,000.


San Diego Gas & Electric v. Donn H. Goss and Beverly J. Goss
San Diego Superior Court, Case No. GIC821722-1

San Diego Gas & Electric condemned 3.72 acres of unimproved commercially-zoned land for a power station. The property consisted mainly of sloping canyon and wetlands, and SDG&E offered $250,000 due to topography and environmental constraints. We argued on behalf of the property owners that the property could nevertheless be developed as an office building and obtained a pre-trial settlement of $1,750,000.


State of CA v. Raymond Ayala, et al.
San Bernardino Superior Court, Case No. 092199

We represented a developer who purchased raw land near a future freeway corridor. The State re-designed the freeway corridor and took the land for freeway purposes. The State offered $90,000 for the parcel. After a four-day bench trial, the Court ruled in our favor that the subject property was entitled to the benefit of the freeway location. The case then settled post bench trial for $400,000.00.


 North San Diego County Transit Development Board v. Cedros Park Partners
San Diego Superior Court, Case No. N46481-1

We represented property owner and received a jury verdict for property taken plus attorneys' fees and costs totaling $2,075,780. The Agency's pretrial offer was $1,571,000, and owner had demanded $1,950,000.



City of San Marcos v. Galletti Brothers Investments
San Diego Superior Court, Case No. N59114-1

We represented a property owner and received a $360,000 jury verdict for property taken. The Agency's pretrial offer was $84,506, and owner had demanded $300,000.



City of San Diego v. Wimpey Commercial, Inc.
San Diego Superior Court, Case No. 6789777-1

We represented a property owner and received a $1,550,000 pretrial condemnation settlement for property acquired and severance damages.



State of California v. Zuhair Hirmez
San Diego Superior Court, Case No. 694899-1

We represented a property owner and received a $723,268 pretrial condemnation settlement for property taken, severance damages and loss of goodwill.



State of California v. Man Leung Wai
San Diego Superior Court, Case No. 645907-1

We represented a property and business owner. The Agency claimed no loss of business goodwill which owner disputed. The case was tried in a two-week jury trial which resulted in a jury verdict of loss of business goodwill of $275,881. The total recovery for property loss of business goodwill and attorneys' fees and costs was $795,171.
