David Semelsberger is a partner at the firm and has been with the firm since its inception in 1987. His practice encompasses all aspects of business law, real estate, and civil litigation.
Mr. Semelsberger has been honored with three Outstanding Trial Lawyers Awards. In 1994, he received his first Outstanding Trial Lawyer Award from the San Diego Trial Lawyers Association for outstanding trial advocacy on behalf of San Bernardino homeowners and obtaining a $5 million judgment in the case of
Barnes, et al. v. J-Mar Investments Co. In 1998 he received a second Outstanding Trial Lawyer Award for his outstanding trial advocacy on behalf of San Diego homeowners in the case of
Chini, et al. v. Elfin Forest Village et al. in which a judgment in excess of $2 million was entered against the defendant.
Mr. Semelsberger has represented individuals, businesses, and homeowners associations in various legal matters during the past two decades. He has testified as both an expert, and as an advocate before the State Legislature on pending legislation.
Mr. Semelsberger's achievements include many successful trial and arbitration results, such as a small corporation's recovery against a lawyer for failure to register securities, a property owner against a business for failure to maintain adjoining premises, an individual against a large U.S. Housing corporation for fraud in the purchase of real estate, defense of a La Jolla art gallery accused of insurance fraud, a sports clothing manufacturer for damages against a printing company, a small entrepreneur against a foreign corporation over the rights to a new invention, a multi-million dollar jury award on behalf of a public charity.
He has also provided legal advice to homeowners associations and individuals in the purchase and sale of real estate, including the purchase of mobilehome parks by mobilehome owners or their conversion to resident ownership.
Mr. Semelsberger has obtained multimillion dollar settlements in cases involving nuisance, negligence, breach of contract and housing habitability claims.
He was educated at the University of Durham, England, St. Vincent College (B.A. with highest honors, 1978), University of Notre Dame Law Center, London, England, and University of San Diego (J.D.
cum laude, 1981), where he was executive editor of the law journal, En Banc, and received American Jurisprudence Awards in Constitutional Law and Evidence, and the Marvin Kratter Award for Excellence in Constitutional Law.
